- “Booking Service” means the service provided by Ammar Cabs in receiving, processing, accepting for regulatory purposes, allocating, administering and supporting a private-hire booking.
- “Transport Service” means the passenger journey carried out by the Driver.
- “Local Journey” has the meaning given in clause 8.
- “ASAP Booking” has the meaning given in clause 11.
- “Airport Booking” means a booking for collection from, or drop-off at, an airport, as described in clauses 12 to 16.
- “Advance Booking” means any booking, other than an ASAP Booking or Airport Booking, made for collection at a specified future date and time rather than as soon as reasonably possible.
2. Ammar Cabs Acts as Booking Agent
Ammar Cabs operates as a licensed private-hire operator and booking agent, licensed by Peterborough City Council under Part II of the Local Government (Miscellaneous Provisions) Act 1976. These Terms apply to bookings made under that licensing regime and do not rely on, or purport to apply, the separate licensing regime under the Private Hire Vehicles (London) Act 1998, which governs private hire operators in Greater London and does not apply to Ammar Cabs.
Drivers undertaking bookings arranged by Ammar Cabs are engaged on a self-employed basis and provide the Transport Service.
When a Driver accepts a booking, the Driver is responsible for carrying out the Transport Service safely and lawfully. Ammar Cabs provides the Booking Service and may also collect or process payment on behalf of the Driver.
Nothing in these Terms excludes, limits or transfers any obligation or liability which applicable law or the Local Government (Miscellaneous Provisions) Act 1976, or other applicable private-hire licensing legislation, places directly upon Ammar Cabs as the licensed operator.
Customers may raise complaints concerning either the Booking Service or Transport Service with Ammar Cabs and we will investigate and, where appropriate, liaise with the Driver.
3. Making a Booking
Bookings may be made by telephone, website, app, WhatsApp, email, approved third-party booking platform or another method accepted by Ammar Cabs.
Customers must provide accurate and complete information, including where applicable:
- pickup address
- destination
- pickup date and time
- passenger telephone number
- number of passengers
- amount and type of luggage
- required vehicle size
- flight number and airport terminal
- wheelchair or accessibility requirements
- additional stops
- any other information reasonably required to carry out the booking safely
Ammar Cabs is not responsible for delays, additional costs or other problems caused by incorrect or incomplete information supplied by the Customer, unless the problem was caused or contributed to by Ammar Cabs.
Submitting a booking request does not guarantee acceptance.
4. Acceptance of These Terms
The current Terms and Conditions are available on the Ammar Cabs website.
Customers should review them before making a booking.
Where practical, booking confirmations sent electronically should contain a link to these Terms.
The version of these Terms in force when the booking is accepted will normally apply to that booking.
A Customer who cannot access the Terms online may request a copy before confirming a booking.
Ammar Cabs may update these Terms for future bookings. Changes made later will not normally alter an already accepted booking unless required by law or expressly agreed.
5. Fares and Quotations
A fixed fare is based on the information provided when the booking is made.
The fare may change if the Customer subsequently requests or causes a material change, including:
- additional pickup or drop-off points
- destination changes
- significant route changes requested by the Customer
- additional waiting
- a different vehicle category
- additional passengers or luggage requiring another vehicle
- other additional services
Where reasonably possible, the Customer should contact Ammar Cabs before agreeing to a material fare change with a Driver.
Any unavoidable fee which can reasonably be calculated in advance should be included in or disclosed with the quoted price.
Variable third-party costs which cannot reasonably be calculated beforehand, such as additional airport parking caused by extended passenger waiting, may be added where the possibility of that charge has been disclosed.
Where a fare quoted, displayed or confirmed contains an obvious pricing error, for example caused by a technical or system fault, Ammar Cabs reserves the right to correct the error and offer the corrected fare, or to cancel the booking and refund any payment already taken, before the journey commences.
6. Payment
The fare for the Transport Service is payable to the Driver.
Where Ammar Cabs accepts cashless or advance payment, Ammar Cabs may collect that payment on behalf of the Driver.
Payment may be required before, during or at the completion of the journey depending on the booking arrangements.
Corporate, council, school or account customers may be subject to separately agreed payment terms.
Customers should only use payment methods or bank/payment details authorised by Ammar Cabs.
If there is uncertainty about whether an electronic payment succeeded, the Customer should contact Ammar Cabs before making another payment where reasonably possible.
Any confirmed duplicate payment will be investigated and the duplicate amount refunded where appropriate.
7. Extra Charges Requested by Drivers
A Driver must not represent an unauthorised charge as an official Ammar Cabs charge.
If a Driver asks the Customer for additional payment which was not included in the booking and does not clearly arise under these Terms, the Customer should contact Ammar Cabs on 01733 555 888 before paying, where reasonably possible.
This does not prevent legitimate additional charges arising from agreed waiting, additional stops, destination changes, parking or another authorised booking change.
Voluntary tips and gratuities are entirely optional.
Ammar Cabs will not normally refund a voluntary tip or other voluntary payment knowingly given directly to a Driver.
If a Customer alleges that a Driver demanded, misrepresented or improperly obtained an unauthorised payment, Ammar Cabs will investigate the matter.
8. Local Journeys
For cancellation-policy purposes, a Local Journey means a journey where the pickup and destination are each within a 10-mile radius of Ammar Cabs' company address in PE1 2DU, as reasonably determined using the booking system or mapping information used by Ammar Cabs.
9. Your Right to Cancel Under the Consumer Contracts Regulations
Passenger transport services do not carry the standard 14-day cancellation (“cooling-off”) right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
This means the cancellation charges set out in clauses 10 to 12 below apply to bookings made with Ammar Cabs, rather than a statutory cooling-off period. This does not affect any other statutory right you may have, including rights arising where a service is not performed with reasonable care and skill.
10. Advance Booking Cancellations
For an Advance Booking other than an Airport Booking:
- 6 hours or more before the scheduled pickup: no cancellation charge.
- Between 3 and 6 hours before pickup: a cancellation charge of up to 50% of the agreed fare may apply.
- Less than 3 hours before pickup: a cancellation charge of up to 100% of the agreed fare may apply.
A no-show may also result in a charge of up to 100%.
Cancellation charges are intended to reflect reasonable loss arising from the cancellation, including Driver allocation, time, mileage, lost booking opportunities and non-recoverable costs.
Where the actual loss is materially lower or the booking can reasonably be replaced, the charge may be reduced as appropriate.
Unless separate cancellation conditions were clearly agreed before booking, the above rules also apply to non-airport advance bookings outside the Local Journey area.
11. ASAP / Immediate Booking Cancellations
An ASAP Booking is a booking requesting collection as soon as reasonably possible rather than at a future scheduled time.
If cancelled within 2 minutes after the booking has been accepted, there will normally be no cancellation charge.
If cancelled more than 2 minutes after acceptance but before the Driver arrives at the pickup address, Ammar Cabs may charge 50% of the agreed fare or £4, whichever is greater.
The charge will never exceed the full agreed fare and remains subject to being reasonable in light of the loss caused by the cancellation.
If the Driver has arrived at the agreed pickup address, a charge of up to 100% of the fare may apply.
Where an Advance Booking Driver arrives early, the Customer will not be treated as late merely because the Driver arrived before the booked pickup time.
12. Airport Booking Cancellations
For pre-booked airport journeys:
- More than 72 hours before scheduled pickup: no cancellation charge.
- Between 24 and 72 hours before scheduled pickup: up to 50% of the agreed fare may be charged.
- Less than 24 hours before scheduled pickup: up to 100% of the agreed fare may be charged.
A passenger no-show may result in a charge of up to 100% of the agreed fare plus reasonable non-recoverable airport parking or access charges already incurred.
These charges remain subject to the general requirement that they reasonably reflect the loss caused by the cancellation.
13. Airport Flight Information
Customers should provide the correct flight number and terminal when booking an airport collection.
Where valid flight information is supplied, Ammar Cabs will use reasonable efforts to monitor flight status.
Ammar Cabs does not control information supplied by airlines, airports or third-party flight-tracking services and cannot guarantee that such information will always be accurate.
Where no valid flight number is provided, Ammar Cabs may treat the original booked pickup time as the applicable collection time.
14. Airport Waiting Time
Unless expressly stated otherwise in the booking confirmation, airport collection bookings include 30 minutes complimentary waiting time from the flight's actual recorded landing time.
After the complimentary period, waiting may be charged at £0.30 per minute.
Variable airport parking, pickup or access costs arising because additional waiting is required may also be payable where applicable.
If a passenger contacts Ammar Cabs and advises that immigration, baggage reclaim, disability assistance or another reasonable circumstance is causing delay, Ammar Cabs will use reasonable efforts to continue or revise the collection arrangement, subject to Driver availability and applicable waiting charges.
15. Flights Delayed by More Than Two Hours
Where a flight is delayed by more than 2 hours from its scheduled arrival time, the originally allocated Driver and vehicle are no longer guaranteed.
Ammar Cabs may reallocate the original Driver to other work and use reasonable efforts to arrange another Driver or revised collection time.
If the delay makes the original arrangement impracticable, Ammar Cabs may contact the Customer to agree revised arrangements.
Ammar Cabs does not guarantee immediate collection following a substantial flight delay.
Where no Transport Service can ultimately be supplied because of the changed circumstances, any payment or cancellation charge will be dealt with reasonably having regard to services performed, costs incurred and applicable consumer law.
16. Airport No Contact — 90 Minute Rule
The Customer must provide a working telephone number for an airport collection.
Passengers should switch on their phone and respond to calls, SMS or WhatsApp messages as soon as reasonably possible after landing.
Where 90 minutes have passed from the flight's actual recorded landing time and:
- the passenger has made no contact with Ammar Cabs;
- the passenger has failed to respond to reasonable attempts by Ammar Cabs or the Driver to make contact; and
- no alternative arrangement has been agreed,
the booking may be treated as a passenger no-show.
The Driver may then be released from the booking.
A cancellation/no-show charge of up to 100% of the agreed fare, together with reasonable airport parking or access costs already incurred, may apply.
If the passenger contacts Ammar Cabs before the 90-minute point and an extended waiting arrangement is agreed, the booking may continue subject to applicable waiting and parking charges.
17. Passenger No-Shows
A booking may be treated as a no-show where the Driver attends the correct agreed pickup location at the relevant time, reasonable attempts are made to contact the passenger and the passenger does not attend or make contact.
For Advance Bookings, a Customer will not be treated as a no-show merely because the Driver arrived before the agreed pickup time.
18. Journey and Arrival Times
Driver arrival times, journey durations, flight-transfer estimates and estimated arrival times are estimates only unless expressly guaranteed in writing.
Traffic, collisions, road closures, weather, police activity, major events, airport congestion and other unexpected circumstances can affect journey times.
Customers travelling for flights, trains, appointments, examinations, events or other time-sensitive commitments should book sufficiently early and allow a reasonable contingency.
Nothing in this provision excludes responsibility where delay has been caused by a failure to exercise reasonable care and skill or where liability cannot lawfully be excluded.
19. Self-Employed Drivers
Drivers receiving work through Ammar Cabs are engaged under self-employed driver arrangements rather than being employed through the Ammar Cabs payroll.
Drivers are responsible for their personal legal and licensing obligations and for their own tax affairs, including any Income Tax, National Insurance, VAT or other obligations applicable to them.
Drivers may use either their own licensed vehicle or, under separate arrangements, a vehicle supplied or made available by Ammar Cabs.
Regardless of vehicle ownership, Drivers are responsible for carrying out appropriate day-to-day safety checks while using the vehicle and for immediately reporting any defect which may affect safety or roadworthiness.
Drivers must not knowingly continue carrying passengers in a vehicle they believe to be unsafe or unlawful to use.
Where the Driver owns or supplies the vehicle, the Driver is responsible for maintaining the vehicle's required private-hire licensing, appropriate hire-and-reward insurance, MOT, roadworthiness, maintenance and other applicable documentation.
Where Ammar Cabs owns or supplies the vehicle, legal responsibilities which fall on Ammar Cabs as vehicle owner, proprietor or insurance policyholder remain with Ammar Cabs. The Driver nevertheless remains responsible for safe day-to-day use, checks and prompt defect reporting while the vehicle is under their control.
Ammar Cabs may immediately stop allocating bookings to a Driver if it becomes aware that required licensing, insurance or authorisation may be invalid.
20. Vehicle Capacity and Luggage
Customers must request a vehicle suitable for the number of passengers and luggage.
A vehicle cannot legally carry more passengers than its licensed or designed capacity.
A Driver may refuse luggage or property which would make the vehicle unsafe, overloaded or unlawful to operate.
Where the Customer gave materially incorrect passenger or luggage information and another vehicle is required, an additional charge may apply.
21. Children
Children must travel in accordance with applicable UK road traffic and seat-belt requirements.
Where a particular child seat is required or desired, the Customer should notify Ammar Cabs when booking.
A particular child-seat type is not guaranteed unless expressly confirmed.
Unaccompanied children will only be transported where expressly agreed or as part of an authorised school, council, social-care or similar transport arrangement.
22. Disabled Passengers and Assistance Dogs
Ammar Cabs and Drivers will comply with applicable legal obligations toward disabled passengers.
No Customer will be charged an additional amount merely because of a disability or because legally required assistance is provided.
Recognised assistance dogs will be carried in accordance with applicable law and without an additional charge, except where a lawful driver medical exemption applies.
Customers are encouraged, where practical, to inform Ammar Cabs of wheelchair, mobility or accessibility requirements when booking so that a suitable vehicle can be arranged.
23. Passenger Conduct
Passengers must not behave in a way which is violent, threatening, abusive, unlawful or creates a material danger to the Driver, passengers, vehicle or public.
Smoking and vaping are not permitted in vehicles.
A Driver may refuse to commence or may terminate a journey where there are reasonable safety or serious misconduct grounds.
Any such decision remains subject to applicable discrimination, equality and consumer law.
24. Vehicle Damage and Soiling
Customers are responsible for damage or exceptional soiling deliberately or negligently caused by them or members of their party.
A reasonable charge may be made for necessary specialist cleaning, repair or other direct losses resulting from that damage or soiling.
Any amount charged must reasonably reflect the loss or cost incurred and will not be imposed simply as an arbitrary penalty.
Normal wear and tear will not be charged.
25. Non-Payment and Making Off Without Payment
Passengers must pay all properly due fares and disclosed charges.
Where a passenger deliberately leaves the vehicle or otherwise avoids payment without the agreement of the Driver or Ammar Cabs, this will be treated as a serious matter.
Ammar Cabs may immediately suspend or permanently block that person's telephone number, account or booking profile and may refuse future bookings.
The unpaid fare will remain due.
Reasonable and evidenced costs incurred in recovering the debt may also be sought where legally recoverable.
Where there are reasonable grounds to believe the passenger deliberately and dishonestly made off without paying, Ammar Cabs and/or the Driver may report the matter to the police or pursue appropriate civil recovery.
A person blocked for deliberate non-payment will not normally be permitted to use Ammar Cabs again unless the outstanding amount and any lawful recovery costs have been settled.
Payment of the outstanding balance does not automatically guarantee that the Customer will be allowed to use Ammar Cabs again.
This provision does not apply in the same way to a genuine payment-system failure, an authorised arrangement to pay later or a genuine fare dispute raised promptly and in good faith.
26. Refusal of Future Service
Ammar Cabs may reasonably refuse future booking requests from a Customer because of serious or repeated:
- non-payment
- fraud
- violence or threats
- abusive behaviour
- deliberate vehicle damage
- harassment
- serious safety concerns
- misuse of the booking service
- other substantial breaches of these Terms
This right will be exercised consistently with applicable equality and consumer law.
27. Fraud Prevention and Identity Verification
Ammar Cabs may take reasonable steps to verify a Customer's identity or booking details, particularly for high-value, high-risk or first-time corporate or account bookings, including requesting confirmation of payment card details or photographic identification.
Ammar Cabs may decline, delay or cancel a booking where verification cannot reasonably be completed, or where there are reasonable grounds to suspect fraud, and will not be liable for any resulting loss or inconvenience where it has acted reasonably and in good faith.
28. Lost Property
Passengers should check that all belongings have been removed before leaving the vehicle.
Where property is found, Ammar Cabs and the Driver will take reasonable steps to safeguard and identify it.
Ammar Cabs does not guarantee recovery of items left in a vehicle.
Reasonable postage, delivery or return costs may apply if the Customer asks for property to be delivered rather than collected.
29. CCTV and Dashcams
Some vehicles used for Ammar Cabs bookings may contain forward-facing dashcams, internal CCTV or other recording equipment for purposes such as safety, incident investigation, insurance, crime prevention and protection of passengers, Drivers and property.
The existence of camera equipment does not guarantee that a particular journey or incident has been successfully recorded.
Recording may be unavailable because of:
- technical failure
- power interruption
- storage failure
- camera obstruction
- corrupted data
- automatic overwriting
- equipment replacement
- other technical circumstances
Requesting Preservation of Footage
Recordings are automatically deleted after 48 hours unless flagged for investigation. Where a Customer believes footage may be required following a journey, they should contact Ammar Cabs as soon as possible, and in any event within 48 hours from the actual passenger pickup time, since footage cannot be retrieved once it has been automatically deleted.
The 48 hours starts from the actual pickup time, not the drop-off time.
Customers should provide sufficient information to identify the recording, including journey date, approximate time, pickup location and booking details.
Ammar Cabs will use reasonable efforts to locate and preserve relevant footage where it is available.
Footage cannot be guaranteed even where the request is made within this timeframe.
Ammar Cabs will not be liable merely because footage does not exist or is unavailable as a result of genuine technical failure or routine overwriting, provided Ammar Cabs has complied with its applicable legal obligations.
A request for preservation is not automatically a right to receive an unrestricted copy. Footage may contain information about Drivers, passengers or members of the public and may require redaction or may lawfully be disclosed only to appropriate parties such as the police, insurers, courts or licensing authorities.
The 48-hour preservation request does not remove or restrict statutory data-protection rights, including the right to make a valid subject access request.
30. Accidents and Safety Incidents
Customers should notify Ammar Cabs as soon as reasonably possible following an accident, passenger injury or serious safety incident connected with a booking.
Drivers are separately required to report relevant accidents and incidents in accordance with licensing, insurance and Driver requirements.
31. Cancellation by Ammar Cabs or Driver Unavailability
Ammar Cabs may need to reallocate a booking where the original Driver becomes unavailable.
Reasonable efforts will normally be made to locate another suitable Driver.
A booking may have to be cancelled where circumstances make performance unsafe, unlawful or reasonably impossible, including vehicle breakdown, licensing restrictions, severe weather, major road disruption or exceptional operational circumstances.
Where a prepaid service is cancelled by Ammar Cabs and no Transport Service is provided through no fault of the Customer, any amount properly due back will be refunded.
32. Events Outside Our Control
Ammar Cabs will not be liable for any failure or delay in providing the Booking Service caused by events reasonably beyond its control, including but not limited to extreme weather, pandemic or public health restrictions, fuel shortages, industrial action or strikes (whether affecting Ammar Cabs, Drivers or third parties), power or telecommunications failure, terrorism, civil unrest, or government or regulatory action.
Where such an event prevents or significantly disrupts Ammar Cabs' ability to provide bookings generally, Ammar Cabs will use reasonable endeavours to notify affected Customers and to resume normal service as soon as reasonably practicable.
Where a booking cannot be fulfilled because of such an event, any amount paid for a service not provided will be refunded, save where Ammar Cabs has already reasonably incurred costs in connection with that booking.
This clause does not affect any statutory right which cannot lawfully be excluded.
33. Liability
Ammar Cabs is responsible for providing its Booking Service with reasonable care and skill and for responsibilities imposed directly on it by applicable law and licensing requirements.
Drivers are responsible for the performance of the Transport Service and their own driving conduct, subject to any responsibility which applicable law also places on Ammar Cabs.
Nothing in these Terms excludes or limits liability where exclusion would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
Ammar Cabs is not responsible for loss which:
- was not caused by a breach by Ammar Cabs;
- was not reasonably foreseeable;
- was caused by inaccurate information provided by the Customer; or
- resulted solely from circumstances outside reasonable control despite reasonable care having been taken.
Subject always to the paragraph above regarding liability which cannot lawfully be excluded, Ammar Cabs shall not be liable for any indirect or consequential loss, including loss of profit, loss of business, loss of opportunity, or costs arising from a missed flight, train, connection, meeting or other time-sensitive event, save where such loss arises from death, personal injury, fraud or fraudulent misrepresentation.
Subject always to the same paragraph, where Ammar Cabs is found liable for a loss arising from the Booking Service, that liability is limited to the value of the fare paid for the booking in question, save where a higher limit is required by law or where the loss arises from death, personal injury, fraud or fraudulent misrepresentation.
Nothing in these Terms removes a Customer's statutory consumer rights.
34. Third-Party Booking Platforms
Where a journey is booked through another booking platform, travel provider, council, school, business or corporate travel service, additional terms may apply.
Where there is a valid separately agreed contract, those terms may take priority over these Terms for the matters they specifically cover.
35. Complaints
Complaints should be raised as soon as reasonably possible. Full detail of our complaint-handling process is set out in our separate Customer Service and Complaint Procedures document, available on request or on our website.
How to Report a Complaint
A complaint may be raised through any of the following methods:
- Email: info@ammarcabs.com
- Phone: 01733 555 888
- In person: Ammar Cabs Ltd, Suite 6, Unit 4 Blenheim Court, Peppercorn Close, Peterborough, England, PE1 2DU
- Online: via our online complaints form at www.ammarcabs.com/contact-us
Please provide the date and time of the incident, the booking reference (if available), the Driver's name or vehicle registration (if known), a detailed description of the issue, and a preferred contact method.
How Complaints Are Handled
Complaints are acknowledged promptly and investigated on receipt. We aim to provide an update or resolution within 24 hours; where more time is needed, we will keep the Customer informed with regular updates and an expected resolution timeline.
Once the investigation is complete, the Customer will receive a detailed response through their preferred contact method.
Escalating a Complaint
If a Customer is unhappy with the outcome, they may escalate the matter to the relevant licensing authority (including Peterborough City Council, which licenses Ammar Cabs) or another appropriate consumer-protection, law-enforcement or regulatory authority. Contact details will be provided on request.
Where a complaint is investigated by an authorised officer of Peterborough City Council, Ammar Cabs will fully comply with their instructions and directions.
Ammar Cabs is not currently a member of an approved Alternative Dispute Resolution (ADR) scheme. Where a complaint cannot be resolved directly, Customers may refer the matter to Peterborough City Council as the licensing authority, or pursue any other right available to them under consumer law, including via the small claims court where applicable.
36. Privacy
Personal information will be handled in accordance with the separate Ammar Cabs Privacy Policy and Cookie Policy, available on the Ammar Cabs website.
37. Entire Agreement
These Terms, together with any booking confirmation and any separately agreed corporate, council, school or account terms, constitute the entire agreement between Ammar Cabs and the Customer in relation to a booking, and supersede any prior representation or agreement, whether written or oral, except that nothing in this clause excludes liability for pre-contractual misrepresentation made fraudulently.
38. No Waiver
A failure or delay by Ammar Cabs in enforcing any provision of these Terms, or in exercising any right under them, will not be treated as a waiver of that provision or right, and will not prevent Ammar Cabs from later enforcing it.
39. Assignment
Ammar Cabs may transfer or assign its rights and obligations under these Terms, for example as part of a business sale, merger or restructuring, provided this does not materially reduce the Customer's rights under these Terms. A Customer may not transfer or assign their rights or obligations under these Terms without Ammar Cabs' prior written consent.
40. Third-Party Rights
Except where a booking is expressly made on behalf of a named passenger, these Terms do not give any person who is not a party to them any right to enforce any provision under the Contracts (Rights of Third Parties) Act 1999.
41. Severability
If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will continue to apply so far as legally possible.
42. Governing Law and Jurisdiction
These Terms are governed by the law of England and Wales.
Any dispute arising out of or in connection with these Terms will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
Nothing in this clause removes any jurisdictional rights available to a consumer under applicable law.
